Terms of Service

These Terms of Service govern your use of PingBase, a status page platform operated by PingBase Inc. Please read these terms carefully before using the Service.

1. Acceptance of Terms

By accessing or using PingBase ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

PingBase provides a status page platform that allows organizations to monitor service health, manage incidents, communicate status to users, and send notifications. The Service includes public status pages, an admin dashboard, monitoring capabilities, API access, and embeddable widgets.

3. Account Registration

You must create an account to use PingBase. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep it updated.

4. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose, (b) attempt to gain unauthorized access to the Service or its systems, (c) interfere with or disrupt the Service, (d) use the Service to send spam or unsolicited communications, (e) exceed rate limits or abuse API access, or (f) resell the Service without written permission.

5. API Keys & Access

API keys are provided for programmatic access to the Service. You are responsible for keeping your API keys secure. Do not share API keys publicly or embed them in client-side code. PingBase reserves the right to revoke API keys that are found to be compromised or misused.

6. Data Ownership

You retain ownership of all data you submit to PingBase. We do not claim any intellectual property rights over your content. You grant PingBase a limited license to use your data solely for the purpose of providing the Service.

7. Service Availability

We strive to maintain 99.99% uptime for the PingBase platform. However, we do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance. See our SLA for specific uptime commitments and remedies.

8. Payment & Billing

Free tier accounts have no payment obligations. Paid plans are billed monthly or annually. Prices are subject to change with 30 days notice. Refunds are available within 14 days of initial purchase. Failure to pay may result in service suspension.

9. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease and your data will be deleted within 30 days. PingBase may terminate accounts that violate these terms without prior notice.

10. Limitation of Liability

PingBase shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim. This limitation applies regardless of the theory of liability.

11. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
